Terms of Service

Overview

These Terms of Service govern your use of the Mobile Cords website and your purchase or use of Mobile Cords products and services.

Mobile Cords provides business-growth services and related tools for businesses. Mobile Cords previously sold physical consumer products, and references to legacy orders in these Terms apply to those historical transactions.

By using the website or purchasing a service, you agree to these Terms and the policies incorporated into them.

Eligibility and Account Information

You must provide accurate information when purchasing or using Mobile Cords services.

You are responsible for protecting credentials associated with accounts you control and for ensuring that information you submit to Mobile Cords is accurate and authorized for use.

Business Services

Mobile Cords may provide services involving marketing content, local-search and SEO workflows, audience-growth activities, business-opportunity intelligence, automation, reporting, or related business-growth functions.

The precise scope of a purchased service is determined by the applicable service description, subscription plan, checkout information, order confirmation, and any applicable onboarding information.

Customer-Provided Information

Some services depend on information supplied by the customer.

You represent that you have the right to provide and authorize the use of photographs, business information, logos, project information, customer-approved materials, account access, and other content that you submit for use in the service.

You are responsible for reviewing information you provide for accuracy.

Mobile Cords may decline to publish or process information that appears materially inaccurate, unlawful, misleading, infringing, unsafe, or outside the purchased service.

Marketing and AI-Assisted Content

Mobile Cords may use software, automation, artificial intelligence, templates, and human review in providing services.

Customers remain responsible for reviewing materials requiring their approval before publication where an approval workflow is provided.

Mobile Cords seeks to base customer-facing content on verified business and project information and does not authorize customers to use the service to fabricate reviews, credentials, completed projects, licenses, locations, customer relationships, or other material facts.

Search Engine Optimization

Search engines independently determine crawling, indexing, ranking, presentation, and traffic.

Mobile Cords may provide search-optimization services and recommendations but does not guarantee a particular ranking, indexing result, search position, traffic level, or placement in an AI-generated response.

Audience Growth and Advertising

Audience-growth or advertising services may involve campaign management, content promotion, or related marketing activities.

Advertising spend is separate from Mobile Cords service fees unless an offer expressly states otherwise.

Mobile Cords will not intentionally initiate customer-funded advertising spend without the authorization required by the applicable service workflow.

Advertising platforms independently determine delivery, reach, cost, account eligibility, and other campaign outcomes.

Mobile Cords does not guarantee a particular number of followers, leads, customers, impressions, conversions, or sales.

Business and Contract Opportunities

Mobile Cords may identify, classify, summarize, or match customers with public or private business opportunities.

Opportunity information is provided as business intelligence and does not constitute a guarantee of eligibility, responsiveness, award, revenue, or contracting success.

Customers are responsible for reviewing solicitation documents, deadlines, qualifications, certifications, insurance requirements, licensing requirements, bid conditions, and other controlling procurement requirements before relying on an opportunity.

Unless a purchased service expressly provides otherwise, Mobile Cords does not submit bids or proposals on the customer's behalf.

Subscriptions and Recurring Billing

Some Mobile Cords services may be offered as subscriptions.

The applicable price and billing interval are disclosed before purchase. By purchasing a recurring service, you authorize recurring charges according to the disclosed billing interval until the subscription is canceled.

Customers may cancel according to the cancellation procedure made available for the subscription.

Cancellation prevents future renewals but does not automatically reverse charges for services already performed or a billing period already underway, except where otherwise stated or required by applicable law.

Prices and Payment

Prices may change prospectively.

A price change does not alter amounts already properly charged for a completed purchase unless otherwise stated.

Applicable taxes and separately authorized advertising expenditures or third-party costs may be charged in addition to Mobile Cords service fees when disclosed.

Third-Party Platforms

Some Mobile Cords services may interact with third-party platforms, including social networks, advertising platforms, search engines, business directories, ecommerce systems, analytics providers, procurement systems, and other technology services.

Those platforms operate independently and may change their features, policies, algorithms, pricing, access requirements, APIs, or availability.

Mobile Cords is not responsible for an independent third-party platform's decisions or service interruptions.

Intellectual Property

Mobile Cords retains its rights in its brand, platform materials, software, workflows, templates, and other proprietary materials except where otherwise expressly agreed.

Customers retain their rights in customer-provided content.

Rights concerning completed customer deliverables are governed by the applicable service description or agreement.

Acceptable Use

You may not use Mobile Cords services to violate law, infringe intellectual-property rights, impersonate another person or business, fabricate material business facts, distribute malicious software, gain unauthorized access to systems, or engage in fraudulent or deceptive conduct.

Legacy Physical-Product Orders

Historical physical-product purchases remain subject to applicable legacy-order rights and the current legacy-order provisions contained in Mobile Cords' Refund and Shipping policies.

Disclaimer

Except to the extent prohibited by law, Mobile Cords services are provided without a guarantee of a particular commercial result.

Marketing performance, search visibility, audience growth, advertising performance, customer acquisition, procurement opportunities, and contract awards depend on factors outside Mobile Cords' exclusive control.

Nothing in these Terms excludes a warranty, remedy, or consumer right that cannot lawfully be excluded.

Limitation of Liability

To the fullest extent permitted by applicable law, Mobile Cords will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the services.

Nothing in this section limits liability that cannot legally be limited.

Privacy

Personal information is handled according to the Mobile Cords Privacy Policy and applicable law.

Changes

Mobile Cords may update these Terms prospectively by publishing a revised version.

Material changes affecting an existing subscription will be handled in accordance with applicable law and the terms governing that subscription.

Governing Law

These Terms are governed by applicable United States federal law and the laws of the State of Texas, without limiting any rights that cannot legally be waived.
